  3. PROPERTY CONDITION DISCLOSURE FORM AND NOTICES TO BUYER.
    1. In the event the SELLER has not furnished the BUYER with the Property Disclosure Form required by §20-327b of the general statues with or prior to the BUYER’S execution of this Agreement, and SELLER is not exempt from the requirement, the SELLER shall give the BUYER a credit of $500.00 against the purchase price at time of closing;
    2. In the event the SELLER has not furnished the BUYER with the Smoke Detector and Carbon Monoxide Detector affidavit required by Public Act 14-272 by the Closing of Title, and SELLER is not exempt form the requirement the SELLER shall give the BUYER a credit of $250.00 against the purchase price at the time of the Closing;
    3. Lists of Hazardous Waste Sites. BUYER is notified that the Department of Environmental Protection is required pursuant to Section 22a-134f of the Connecticut General Statutes to furnish lists of hazardous waste facilities located within a town to the Town Clerk’s office. BUYER should refer to these lists and the Department of Environmental Protection for information on environmental questions concerning the Property and the land surrounding the Property;
    4. Lists of Properties where Shooting Sports Conducted. BUYER is notified that a list of local properties upon which hunting or shooting sports regularly take place may be available at the Town Clerk’s Office;
    5. Information Concerning Environmental Matters. BUYER is notified that information concerning environmental matters on the Property and surrounding properties is available from the federal Environmental Protection Agency, the National Response Center, the Department of Defense and third-party providers;
    6. Educational Material Concerning Well Water Testing. If the Property is served by a private well, BUYER is notified that important educational material concerning private well testing is available on the Department of Public Health’s web site.

This online document contains a list of certain understandings the parties have reached which may become part of a contract if the parties enter into a contract. The parties do not intend to be bound by any of this online document as they intend to agree to and sign a formal written contract. Until such a contract is negotiated and properly executed, neither party shall have any obligation to the other (whether under this online memorandum or otherwise), with the sole exception of an obligation to negotiate in good faith towards the goal of reaching such an agreement. This paragraph supersedes all other conflicting language in this online document. Neither party may reasonably rely on any promises inconsistent with this paragraph.
